Certificates represent a binding contract of insurance subject to the terms, conditions, exclusions, and limitations specified in the certificate and underlying policy.

6.3 Coverage Limitations

All insurance coverage is subject to:
  • Policy limits specified in your certificate
  • Deductibles applicable to your commodity and coverage type
  • Exclusions outlined in policy terms
  • Accurate declaration of shipment value and details
We are not liable for claims arising from:
  • Misrepresentation or non-disclosure of material facts
  • Commodities not covered under your policy
  • Perils excluded from your coverage type
  • Values exceeding your declared coverage amount

6.4 Claims

All claims must be filed in accordance with our claims procedures, including:
  • Timely notification (within 30 days of delivery or discovery of loss)
  • Complete documentation as specified in our claims requirements
  • Cooperation with investigation and survey processes
  • Compliance with salvage and subrogation obligations
Fraudulent claims will result in immediate denial, account termination, and potential legal action.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $500, WHICHEVER IS GREATER.

Our liability for insurance coverage is strictly limited to the terms, conditions, and policy limits specified in issued certificates. Any disputes regarding coverage must be resolved in accordance with the insurance policy terms and applicable insurance law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Inman Maritime Corporation, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:
  • Your violation of these Terms
  • Your use of our services
  • Your violation of any rights of a third party
  • Fraudulent or false information you provide
  • Any claims filed by you that are determined to be fraudulent

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

12.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Vancouver, British Columbia, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue.

12.3 Arbitration

For disputes not related to insurance claims (which are governed by insurance policy terms), we may require binding arbitration as an alternative to litigation. Details of arbitration procedures will be provided if such requirement is invoked.

12.4 Insurance Claim Disputes

Disputes regarding insurance coverage, claims, or policy interpretation shall be resolved in accordance with:
  • The terms and conditions of the applicable insurance certificate
  • Applicable insurance laws and regulations
  • Industry standard arbitration or mediation procedures for insurance disputes

13. COMPLIANCE WITH LAWS

13.1 International Trade Compliance

You agree to comply with all applicable international trade laws and regulations, including but not limited to:
  • Export and import controls
  • Sanctions and embargoes
  • Anti-money laundering requirements
  • Customs regulations
You represent and warrant that your shipments do not violate any applicable trade restrictions or sanctions.

13.2 Prohibited Destinations and Parties

We do not provide coverage for shipments:
  • To or from countries under comprehensive international sanctions
  • Involving parties on sanctions lists (OFAC, UN, EU)
  • That violate export control laws
  • Involving prohibited or restricted commodities under applicable law
You are responsible for ensuring your shipments comply with all applicable laws.

14. FORCE MAJEURE

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:
  • Acts of God (natural disasters, epidemics, pandemics)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Labor disputes or strikes
  • Telecommunications or internet failures
  • Power outages or infrastructure failures

15. SEVERABILITY

18. ASSIGNMENT

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign or transfer these Terms or any rights or obligations hereunder at any time without your consent.

19. SURVIVAL

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, limitation of liability, indemnification, dispute resolution, and governing law provisions.
